Common Criminal Cases

Criminal charges can be separated into three categories: minor misdemeanors; misdemeanors; and, felonies.  The different classifications is based upon the seriousness of the offense and the amount of punishment given to a person found guilty of the charge.

Criminal Defense Strategies

Crimes of Violence – Assault, Domestic Violence, Aggravated Menacing, Inducing Panic

Theft Offenses
– Theft, Petty Theft, Shoplifting; passing bad check, receiving stolen property, forgery, unauthorized use of property, identity theft , burglary, breaking and entering, Medicare / Medicaid fraud, embezzlement

Drug Offenses
– drug Abuse, possession of marijuana, drug Paraphernalia , possession of drugs, trafficking in marijuana, cultivation of marijuana, trafficking in drugs, deception to obtain drugs,

Other Criminal Offenses
– assault, negligent assault, criminal trespass, disorderly conduct, weapons violations, carrying a concealed weapon, improper handling of a firearm, domestic violence (M4) telephone harassment, soliciting, obstruction of justice, gambling, and many others.

There are five levels of Misdemeanor Charges and penalties:

M1 – Misdemeanor 1st Degree – Penalty up to 6 months jail & $1,000 fine.
M2 – Misdemeanor 2nd Degree – Penalty up to 90 days jail and $750 fine.
M3 – Misdemeanor 3rd Degree – Penalty up to 60 days jail and $500 fine.
M4 – Misdemeanor 4th Degree – Penalty up to 30 jail and $250 fine.
MM – Minor Misdemeanor – Penalty no jail and up to $150 fine.

There are five levels of Felonies
Charges and penalties:

F1 – Felony 1st Degree – Penalty up to 3-11+ years and $20,000 fine.
F2 – Felony 2nd Degree – Penalty up to 2-8 years and $10,000 fine.
F3 – Felony 3rd Degree – Penalty up to 9-60 months and $7,500 fine.
F4 – Felony 4th Degree – Penalty up to 6-18 months and $5,000 fine.
F5 – Felony 5th Degree – Penalty up to 6-12 months and $2,500 fine.
